End User Licence Agreement

This agreement covers the app itself. The Terms of Service cover this website and buying a licence through it; where the two overlap, this one governs the software.

1. The licence you get

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use eKoPlayer on one device per licence, for your own private, non-commercial use. You are buying permission to use the software; you are not buying the software.

A device is identified by the Device ID shown on the account screen. Because that ID is derived from the device, a factory reset produces a new one — see the Terms of Service for how re-issue works.

2. Trial

A new installation may be used in full for seven days without payment. The trial is per device and may be used once.

3. What you may not do

• Copy the app except as necessary to install and back it up.
• Rent, lease, lend, sell, sublicense or distribute it, or a licence for it.
• Modify it, translate it, or create derivative works from it.
• Reverse-engineer, decompile or disassemble it, except to the extent that this restriction is expressly prohibited by applicable law, and then only to that extent.
• Remove or alter any notice of ownership in it.
• Defeat, bypass or tamper with the licensing, or help anyone else do so.
• Use it in a commercial setting — a bar, a hotel, a rental property or a business — without a separate written agreement with us.

4. Content is yours, and yours alone

• This app does not provide or include any media content.
• Users must add their own content from authorized sources.
• This app has no affiliation with any third-party provider.
• This app is intended solely for streaming media the user has legal access to.

You alone are responsible for anything you add to the app and for having the right to access it. We have no visibility of it, no control over it and no means of obtaining it. Adding content you are not entitled to breaches this agreement and the Acceptable Use Policy.

5. Ownership

eKoPlayer, its name, its logo and all intellectual property in it belong to PolarCurve LLC. The app includes third-party open-source components, each under its own licence; those licences are listed in the app under Settings, and nothing here overrides them.

6. Updates

We may issue updates. Where you installed from a store, that store may install them automatically. An update is covered by this same agreement unless it comes with its own.

7. No warranty

The app is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will work with every source, every device or every network, or that it will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent the law allows, we are not liable for lost profits, lost data, or any indirect, incidental, special or consequential damages arising from the app, and our total liability is limited to what you paid for your licence. Some jurisdictions do not allow these exclusions; where that is so, they do not apply to you.

9. Termination

This licence ends automatically if you breach it. On termination you must stop using the app and remove it. Sections 5, 7, 8 and 10 survive.

10. Law

Governed by the laws of the State of Wyoming, United States, without prejudice to consumer rights you hold under the law where you live.
